Dont know any rules but if I was in a balloon I wouldn't want to see one. To be safe I would stay at least 200 yards away. This is just a guess. I would never go above them at all.

You cannot create a hazard to other aircraft, Ref FAR 101.43 and FAR 91.111

This is an international forum so...... what country are you talking about? (Different rules from different aviation authorities)
