Replacement without DJI Care Refresh?

I've decided to get myself a red DJI Spark soon, but was wondering if I can get a replacement (in case of a non-user fault) without purchasing the DJI care refresh?

I've heard that DJI will only replace your drone if you:
1. purchase dji care refresh
2. ship them the damaged drone

Will they replace my drone if it were to crash due to a hardware malfunction? (no piloting errors involved)

They will replace it IF the cause was 100% malfunction of device, but it some/most cases its hard to prove. Do yourself a favor and spend the $59 for DJI Refresh.
