it would seem to me the DJI would at least let you use hand jestures in a NFZ so people could use the spark in your back yard that would be part of your software.

While I agree, the law is the law and DJI is basically limiting their liability. Until the day the Feds put some common sense into some of regs, this is the world we live in.
